Upon acceptance of the website proposal, the Client will be invoiced for fifty percent (50%) of the “Total Estimated Client Investment” outlined in the proposal and the Website Project
Initiation call will be scheduled upon receipt of deposit.

Final Payment For the Birth Your Brand Package
Final payment is due 30 days from date of deposit or on the date of the Reveal Call, whichever comes first. Websites are created on a temporary address and are not made “live” until final payment is received.

Final Payment For the Expand Your Brand Package
Final payment is due 30 days from date of deposit or on the date of the Reveal Call, whichever comes first. Websites are created on a temporary address and are not made “live” until final payment is received.
**Please note that the final balance due may include fees for additional graphics, pages, add-ons and services fees described in this agreement and agreed to by the Client. The final invoice will contain a detailed accounting of any and all additional fees.
Billable Exclusions
Any and all exclusions (including but not limited to image-editing beyond scope, annual web hosting fees, annual domain name registration and/or renewal fees, additional concepts or color versioning beyond scope), project work or project services performed or conducted outside of the agreed-upon project scope are billable at an hourly rate of $50 or as otherwise noted in this agreement. All expenses are billed at a 10% markup.
Project Cancellation
In the event of cancellation of a project during its execution or rejection of a completed project, ownership of all copyrights, the original artwork and project elements completed to that date shall be returned to Creating Websites That Work and/or Hummingbird Creative Concepts. Deposit will in turn be forfeited and all additional labor and expenses beyond the original deposit amount will be billed at the hourly rate of $75/hr. Any usage by the Client of those design elements will result in appropriate legal action. Client shall bear all costs, expenses, and reasonable attorney’s fees in any action brought to recover payment under this contract or in which the designer may become a party by reason of this contract..
